General conditions of sale for orders via GROOPAY

I. PREAMBLE

S&J EPICURIENS specifies that sales in the “GROOPAY” catalog (hereinafter “the Catalogue”) are exclusively reserved for professionals for the needs of their gifts intended for people with a delivery address located in one of the zones served by S&J EPICURIENS, as indicated when placing the order, any order for resale or use in the context of a catering, event, restaurant or hotel activity being excluded. Any order not corresponding to needs as defined in the previous paragraph cannot be accepted by S&J EPICURIENS. These general conditions of sale and the specific conditions of sale specific to each of the items offered in the Catalog solely govern the relations between the company S&J EPICURIENS (SARL with capital of €1,000, whose head office is located at 13008 Marseille, 481 avenue de Mazargues, registered in the Marseille Trade and Companies Register under number 901 729 590, identified under intra-community VAT number FR 14 901 729 590) and its customers, with the exception of all other conditions.

II. ACCEPTANCE OF THE GENERAL AND SPECIAL CONDITIONS OF SALE

Placing an order with S&J EPICURIENS implies full and complete acceptance on the part of the customer of these general conditions of sale of S&J EPICURIENS and the specific conditions of their order (items ordered within the limits of the quantities possibly mentioned, name, price , components, etc.).

III. PRODUCTS

Each item offered in the Catalog is the subject of a summary presentation indicating its name, its quantity and its price. The photographs illustrating the products are indicative of the general presentation of the product. Also, and given the food nature of most products, it is possible that the aesthetic presentation of the products delivered presents minimal variations compared to that present in the Catalogue.

IV. OFFER VALIDITY DURATION

Our offers are valid until March 31, 2024, while stocks last. If the product is unavailable after placing your order, we will contact you by telephone or e-mail as soon as possible to inform you and agree with you:

  • to replace the product with another equivalent in quality and price, the shipping costs of the equivalent product being in this case the responsibility of S&J EPICURIENS;
  • to cancel your order and reimburse you for any price paid within a maximum of thirty days following your request by bank transfer or check.

V. FORMATION OF THE CONTRACT: OPERATING MODE

Subject to the reservation referred to in the following paragraph, the customer's order is considered firm and final upon receipt by S&J EPICURIENS of its order form. Any order, regardless of the payment method used by the customer, will only be considered accepted by S&J EPICURIENS after receipt by it of confirmation of collection of the price. In the event of non-payment, partial or total, the order cannot be followed up, and the customer will be informed by email or telephone. The information provided by the customer when taking the order binds him: in the event of an error by the customer in the wording of his contact details or those of the place of delivery, in particular name, first name, address, telephone number, address electronic, door code, floor resulting in the impossibility of delivering the products, or the loss and/or destruction of the products, the customer will remain responsible for their payment.

VI. PRICE

All prices indicated in our Catalog are expressed in euros. They are valid until March 30, 2024. They detail the prices excluding taxes and all taxes included as well as the delivery costs, which must be paid additionally depending on the weight and destination of the order. The prices of similar products sold by S&J EPICURIENS in the physical point of sale or on the S&J EPICURIENS website may be different from the prices in the Catalog, without the customer being able to claim the acquisition of the Catalog products at the store price or internet price .

VII. PAYMENT

Payment is made via the Groopay platform.

VIII. DELIVERY

8.1 The order can only be shipped after receipt of the order form duly completed, dated and signed, and paid in full, according to the accepted payment terms (price of the products and transport costs). In the event of a case of force majeure within the meaning of the Civil Code, which would prevent delivery of the order on time, S&J EPICURIENS will notify the customer as soon as possible.

8.2 delivery costs being calculated according to the order and the place of delivery, they are detailed in the quote communicated by S&J EPICURIENS.

8.3 Deadlines

8.3.1 In mainland France

The usual delivery times, excluding holiday periods (Christmas, New Year's Day, Easter) are 10 working days (i.e. excluding Saturday, Sunday and public holidays) from the day following receipt by S&J EPICURIENS of the order form accompanied by full payment. During the holidays, these deadlines, given for strictly indicative purposes, are at least 15 working days. Thus, and as an example, any order to be served by December 22, 2023 must have been received, and paid, no later than December 1, 2023.

8.4.2 Outside mainland France

Depending on the products and countries, delivery times can vary by several days or even weeks. S&J EPICURIENS invites the customer to contact Le Coin des Épicuriens in order to check the delivery times applicable to their order.

8.4.4 Terms

For all deliveries other than those provided by the driver service (within the limits of the areas served by this means), delivery will be made in so-called “Chronopost” mode in France and in all countries accepting this mode of transport. In other countries, shipping is made, unless expressly requested by the customer, by postal parcel. For deliveries outside the European Union, the customer undertakes to pay all taxes due on the importation of products and claimed upon delivery of the packages, such as customs duties, value added tax and /or any other taxes due under the laws of the country in which the order is received. S&J EPICURIENS disclaims all legal liability if taxes are not paid by the customer. The customer is required to check the condition of the products delivered and, in the event of shortages or damage, to submit any reservations to the carrier by registered letter with acknowledgment of receipt within seventy-two hours of delivery. In the event of non-compliance or apparent defect of the products delivered, the customer has a period of three (3) working days from receipt of them to inform the head office in writing (postal mail or e-mail). a complaint accompanied by a photograph clearly showing the damage. After this period, the products delivered will be deemed to be compliant and free from all apparent defects. In the event of delivery to the recipient's workplace, the customer must take all necessary precautions so that the carrier, not having access to the premises, can deliver the order to the recipient and the latter receives it. As soon as the package is presented by the postal services or the carrier at the address indicated by the customer, S&J EPICURIENS has fulfilled its delivery obligation. S&J EPICURIENS therefore declines all liability in the event of subsequent loss or theft.

8.5 Return costs In the event of return to S&J EPICURIENS of products ordered by the postal services or the carrier due to either (i) the absence of collection of the package by the recipient within the period specified on the delivery notice left by postal services or the carrier, either (ii) inaccessibility of the recipient due to errors or inaccuracies in the wording of their contact details and/or delivery address, or (iii) refusal of the package by the recipient for personal convenience, all costs will be the responsibility of the customer. They understand :

  • For deliveries in mainland France: the return costs to S&J EPICURIENS as well as the costs of returning the products to the recipient, which will be invoiced at the same price as for delivery.
  • For international deliveries: the return costs to S&J EPICURIENS as well as the costs of returning the products to the recipient, which will be invoiced at the same price as for delivery in the case of sending by postal parcel, and, in other cases case, depending on the quote communicated by the carrier. However, and in the event that the return costs are higher than the value of the products plus the return costs, the products ordered will be destroyed on site, the costs of destroying the goods, the cost of the new package and the costs of returning it to the recipient being the responsibility of the Customer.

IX. RESERVATION OF OWNERSHIP AND TRANSFER OF RISKS

The products invoiced to the Customer and delivered will remain the property of S&J EPICURIENS until full payment of their price, giving S&J EPICURIENS the option of claiming said products in the event of non-payment. The above provisions do not prevent, from delivery, the transfer to the customer of the risks of loss or deterioration of the products as well as the damage that they could cause. The return of products is carried out at the risk and expense of the customer.

x. PRODUCT CONFORMITY GUARANTEE

S&J EPICURIENS is bound by legal guarantees on products, under the conditions provided for in the Civil Code.

XII. NOMINATIVE INFORMATION

The information communicated by the Customer when placing an order is subject to computerized processing by S&J EPICURIENS in order to ensure the proper execution of orders. The data collected when placing the order is kept for a period not exceeding that necessary for the purposes for which they are processed. This data may then be archived for an additional period for strictly limited reasons authorized by law (payment, guarantee, disputes, etc.). These data may only be communicated to the internal department of S&J EPICURIENS and to its service providers involved in the placing and monitoring of the order as well as the transport. In accordance with the regulations applicable to the protection of personal data (arising from May 25, 2018 from the European Regulation on the Protection of Personal Data), the Customer has the right to request access, rectification or erasure personal data, or a limitation of processing, or the right to object to processing and the right to data portability which he can exercise by sending an email to the following address: contact@lecoindesepicuriens.com or by writing at the head office of the Company S&J EPICURIENS located 481 avenue de Mazargues 13008 Marseille. The Customer may also lodge a complaint with the CNIL.

XIII. PROTECTION OF MINORS

Please note that, in accordance with the provisions of the Public Health Code, the sale of alcohol to minors is prohibited. Any person ordering through the Catalog must be at least eighteen years old on the date of the order.

XIV. DISPUTES

These general conditions as well as all the operations referred to therein are subject to French law. In the event of a dispute, the customer will contact S&J EPICURIENS as a priority to find an amicable solution. Failing this, the case will be brought before the competent French courts.
